Statute of Limitations and Car Insurance

You have a certain amount of time when you get into an accident to file your claim and get it settled. Let’s see how a statute of limitations can affect you and your car insurance claim.

Statute of Limitations Defined

A statute of limitations is the term used by the legal system to define the time limits for initiating claims or other legal actions.

These time limits will vary from state to state. For example, in California, you have the following amounts of time to file a lawsuit for cases regarding auto insurance:

  • 2 years for cases involving personal injury .
  • 3 years for property damage .

To find out what the limits are in your state, speak with your attorney.

Why Are Statutes of Limitations Enforced?

Statutes of limitations are imposed to ensure a fair case. Setting a reasonably short deadline for a lawsuit is smart, because over time:

  • Memories fade.
  • Witnesses move away, disappear, or die.
  • Evidence gets lost.

Statutes of Limitations and Accidents

Generally, an auto accident claim for minor personal injuries and damage to your car and other property is covered by the basic statutes, which in most states range from 2 to 6 years, with some exceptions.

However, if somebody dies in the accident, the claim is escalated to wrongful death. which has a much longer time limit in certain states.

Handling the Initial Claim

When you get into an accident, chances are you will be dealing mostly with the claims adjuster for the at-fault driver’s car insurance company – at least initially. You also have to report the accident to your own insurance carrier. Your claims for compensation will likely be covered, at least to an extent, by the other driver’s liability auto insurance policy.

If your policy includes coverage for uninsured/underinsured motorists. you may make a claim with your own insurance company for the difference between your claim amount, up to the amount of coverage you purchased, and the limits of the other driver’s coverage.

If that is still insufficient, you may wish to file a lawsuit against:

  • The other driver’s carrier.
  • Your carrier.
  • The other driver.

Working with a Lawyer

If you are concerned about the statute of limitations, consider working with a lawyer. A lawyer can help you work with the insurance companies, file your personal injury claim with the court, and work through the details regarding the statute of limitations.

Claims Against the Government

Whether it’s the federal, state, or local government who is at fault in your accident, bear in mind that statutes of limitations are different from those specified by state law. In most cases, the time limits are much shorter for government entities.

Depending on which government agency is involved, those limits can be as short as 60 days, so it pays to learn what their statute of limitations are as soon as possible.

When you’re making a claim against any government agency, consider retaining an attorney from the very beginning.

Free Intrusion Detection (IDS) and Prevention (IPS) Software

Intrusion detection tools

Intrusion Detection Systems (IDS) were developed in response to the increasing frequency of attacks on networks. Typically, IDS software inspects host configuration files for risky settings, password files for suspect passwords and other areas to detect violations that could prove dangerous to the network. It also sets in place ways for the network to record suspicious activities and potential attack methods and to report them to an administrator.

An IDS is similar to a firewall, but in addition to guarding against attacks from outside the network, an IDS identifies suspicious activity and attacks from within the system.

Some IDS software can also respond to intrusions it detects. Software that can respond is usually referred to as Intrusion Prevention System (IPS) software. It recognizes and responds to known threats, following a large body of criteria.

In general, an IDS shows you what is happening, while an IPS acts on known threats. Some products combine both features. Here are a few free IDS and IPS software options.

Snort for Windows

Snort for Windows is an open source network intrusion detection system, capable of performing real-time traffic analysis and packet logging on IP networks. It can perform protocol analysis, content searching/matching and can be used to detect a variety of attacks and probes, such as buffer overflows, stealth port scans, CGI attacks, SMB probes, OS fingerprinting attempts and much more.

Suricata

Suricata is open source software that has been called Snort on steroids. It delivers real-time intrusion detection, intrusion prevention, and network monitoring. Suricata uses a rules and signature language and Lua scripting to detect complex threats. It is available for Linux, macOS, Windows and other platforms.

The software is free, and there are several fee-based public training events scheduled each year for developer training. Dedicated training events are also available from the Open Information Security Foundation (OISF), which owns the Suricata code.

Bro IDS

Bro IDS is often deployed in conjunction with Snort. Bro s domain-specific language does not rely on traditional signatures. It logs everything it sees in a high-level network activity archive. The software is particularly useful for traffic analysis and has a history of use in scientific environments, major universities, supercomputing centers and research labs for securing their systems. The Bro Project is part of the Software Freedom Conservancy.

Prelude OSS

Prelude OSS is the open source version of Prelude Siem, an innovative hybrid intrusion detection system that is designed to be modular, distributed, rock solid and fast. Prelude OSS is suitable for limited-size IT infrastructures, research organizations and for training. It is not intended for large-size or critical networks. Prelude OSS performance is limited but serves as an introduction to the commercial version.

Malware Defender

Malware Defender is a free Windows-compatible IPS program with network protection for advanced users.

It handles intrusion prevention and malware detection. It is well-suited for home use, although its instructional material is complicated for average users to understand. Formerly a commercial program, Malware Defender is a host intrusion prevention system (HIPS) that monitors a single host for suspicious activity.

ABOUT US

In 1976, Lee Ora Pedrick acquired the 11-acre Black Bart’s Recreational Vehicle Park at 2760 East Butler Avenue in Flagstaff. The building that is now the restaurant was then a recreational facility for the park. In 1979, the Pedricks decided to open a steakhouse utilizing the talents of NAU students as singing servers to entertain customers. The students’ response was so great that plans were immediately formulated to build and open the adjoining Old West Theatre. where the Black Bart’s Vaudeville Show Old West Melodrama was produced for 11 years, through the summer of 1990.

In 1991, it was decided to discontinue the Old West Theatre and replace it with a more comprehensive Musical Revue that continues today. The wall between the steakhouse and the theatre was removed, creating a much larger restaurant which provided better facilities for a greater number of people to enjoy our unique blend of food and entertainment.

On January 2nd, 1992, a tragic plane crash claimed the lives of Lee Ora Pedrick.

Black Bart’s Steakhouse has continued operation with its ownership in the hands of the Pedrick Family Trust, and carries on its tradition of great food and entertainment in the same manner Lee Ora designed. It remains our goal to create a living memorial to their memories and dedication.

Charles E. Boles

Charles E. Boles was born Charles Earl Bowles, but later changed the spelling of his name to “Boles.” He was also known as Charles Bolton or C.E. Bolton, but was, of course, best known as Black Bart or Black Bart the Po8. He is known for robbing Wells Fargo stagecoaches in northern California and southern Oregon from 1875 to 1883.

Black Bart robbed only Wells Fargo stagecoaches. Masked, he would jump in front of the coach, point a 12 gauge shotgun at the driver, and demand the strong box in a deep, resonant voice. He never fired a shot, never hurt anyone, and never robbed the passengers in the coach. After his capture in November 1883, it was discovered he never even loaded the gun.

After being captured, Bart was sentenced to 6 years in San Quentin prison, but was released after 4 for good behavior. Upon his release, Bart was asked if he’d go back to robbing stagecoaches. Bart said he was through with crime.

Bart then returned to San Francisco, where he lived for a month, then disappeared without a trace in February 1888.

They perform songs from musicals, and will even take requests. The music is amazing, but the food is superb as well. Salads are fresh and crispy, biscuits are served hot with honey cinnamon butter, and the main courses are served to order. The wait staff are friends and attentive, even though they sing songs in stern service. Come and stay awhile- you’ll love it.

I’m so glad we came across this place through Yelp. It isn’t easily marked from the hwy so finding it was a gem. I ordered a 12 oz prime rib and it came out at about a 15 or 16 oz cut. It was amazing. The service was really great too. Taylor was our server and Cameron was his helper for the evening. They were on top of everything and our cups were never half empty. If you have a chance to stop here you won’t regret it.

I LOVE this place. I drove 534 miles to get here today (ok yeah Im a driver by trade but still) and was delighted to find that Stacy still works here. She took my request to sing “Climb Every Mountain” and was awesome as ever.

Speaking of dinner, it was as fantastic as I had hoped. The menu was fairly simple but should have enough options to satisfy most patrons. There were at least 5 different items on the menu that I would have ordered. I decided the go with the special for the night, a 16oz bone-in ribeye. Every meal comes with a side salad and a side. The steak was cooked to perfect medium as I requested. My buddies had bbq chicken and a rack of ribs. I was able to get a taste of both dishes and they were delightful; succulent, tender and perfectly seasoned. Dinner also included complementary sourdough biscuits with maple cinnamon butter, definitely a nice touch. The overall experience was incredible. Our waitress was knowledgable, friendly and put in a great performance singing! This place certainly deserves numerous visits anytime you find yourself in Flagstaff!

I have installed the app but when i click on the button to link my FB account, nothing happend. I have turned off my pop-up blocker but no success.

Don t waste your time. Our shop synchronized beautifully with our Facebook shop. We have over 18,000 products. Everything was working great! Then one day it just stopped working. Only 100 products displaying and most categories just disappeared. I tried relaunching, I tried republishing, I tried resynching and nothing. I contacted shopify support who claims they will escalate this but now I am looking online and found this has happened to hundreds of shopify shop owners. My once beautiful shop is just a shell now. I can t believe Shopify is just sitting by letting this happen.

I have thousands of items available in my Shopify store and within a few hours I had them all available on my Facebook store with very little problems. Why not take advantage of another selling platform for free?

I have watched numerous people go through the same problems that I encountered. I don t see why this is still available in its current form when it obviously doesn t work. FIX IT OR GET RID OF IT! Not working! There s enough comments on here – why hasn t this been dealt with yet. I don t feel like going in and setting up an additional store on facebook.

Thanks for the feedback Tempest Operations. Tried that, but no luck. By the way I was instructed by Shopify after several days of dealing with this to contact Facebook. Really – apparently this is impossible. Just go to Facebook on their FB page and see what a bitch fest it is because they have no way of contacting anyone.

Really bad. They need to do major work with this app. My store has over a hundred products and less than 1/3 integrated in Facebook! It wouldn t allow me to integrate anything that had a variant like an e-book or mp3 as well as physical version and every attempt to fix the problem led to more error messages. All the youtube tutorials I watched couldn t help fix the issues so I deactivated the whole thing after about 30 minutes. Utterly useless app!

Lymphedema After Breast Cancer Surgery

Have you noticed swelling in your arms or legs after breast cancer surgery? If so, tell your doctor. She might want to check you for lymphedema. It’s common for women to get this condition after their breast cancer treatment .

What Is Lymphedema?

The buildup of lymph, a fluid your body makes, happens when lymph vessels or nodes that the fluid travels through are missing, damaged, or removed.

There are two types of lymphedema. primary and secondary.

Primary is rare. It happens when certain lymph vessels are missing or faulty at birth.

Secondary lymphedema happens when a blockage or another problem changes the flow of lymph fluid through your body’s network of lymph vessels and nodes. It can develop not only after breast cancer surgery, but can also come from an infection, scar tissue formation, trauma, deep vein thrombosis (a blood clot in a vein), radiation. or other cancer treatments.

Who’s at Risk for Lymphedema?

People who’ve had any of these procedures may be at risk:

  • Simple mastectomy in combination with axillary (arm pit) lymph node removal
  • Lumpectomy in combination with axillary lymph node removal
  • Modified radical mastectomy in combination with axillary lymph node removal
  • Combined cancer surgery and radiation therapy to a lymph node region (such as the neck, armpit. groin, pelvis, or abdomen )
  • Radiation therapy to a lymph node region

You can get lymphedema within a few days of surgery, but it can also happen months or years afterward. If untreated, it can become worse.

What Are the Symptoms?

A small amount of swelling, even in your arm, is normal for the first 4 to 6 weeks after breast cancer surgery. Some women may also have redness or pain in the arm, which may be a symptom of inflammation or an infection.

But if you think you have any of the symptoms below, call your doctor right away. Prompt treatment can help get lymphedema under control.

  • Swelling in the arms, hands, fingers, shoulders, chest, or legs.
  • A “full” or heavy sensation in the arms or legs
  • Skin tightness
  • Less flexibility in your hand, wrist, or ankle
  • Trouble fitting into clothing in one specific area
  • A tight-fitting bracelet, watch, or ring that wasn’t tight before

Your doctor will look into your medical history (including past surgeries and treatments) and your current medications and symptoms. She’ll also give you a complete physical exam. She might ask you to take other tests, too, like an MRI. CT scan. or ultrasound to check for fluid build-up.

How Is Lymphedema Treated?

It depends on how bad the swelling is and its cause.

If an infection’s to blame, for example, your doctor may prescribe antibiotics .

Other treatments can include bandaging. proper skin care and diet, compression garments, exercises, and manual lymphatic drainage, a gentle form of skin stretching and massage .

Get treated ASAP to nip potential problems in the bud. If you don’t get medical care for lymphedema, it can lead to more swelling and a hardening of the tissue — and that can impact how well your affected limb moves and works. It can also lead to infections and other illnesses.

How Can I Avoid Getting Lymphedema?

Take good care of yourself to lower your odds of getting the condition.

  • Cut back on foods high in salt and fat.
  • Have at least two to four servings of fruits and three to five servings of vegetables each day.
  • Eat a variety of foods to get all the nutrients you need.
  • Use the package label information to make healthy choices.
  • Get fiber from whole-grain versions of breads, cereals, pasta, and rice. Fruit and veggies are good sources too.
  • Drink plenty of water.
  • Stay at your ideal body weight. A registered dietitian or your doctor can calculate it.
  • Avoid alcoholic drinks.

First, check with your doctor before you start a new exercise program .

Depending on what he gives you the OK to do, you could take walks, swim, or do low-impact aerobics like biking — all of which are aerobic workouts that get your heart pumping. Your care team might also give you specially prescribed exercises. Whatever you do, aim to get 30 minutes of exercise a day at least 5 days a week.

Include a 5-minute warm-up before any aerobic activity, and take 5-10 minutes to cool down after your workout.

If your normal exercise routine includes upper-body weight lifting. check with your doctor about the best time to get back to it as well as any weight restrictions.

Stop doing any exercise that gives you pain. And if your arm on the side where you had surgery becomes tired during exercise, cool down, then rest and elevate it.

  • Wear gloves while doing housework or gardening.
  • Avoid cutting your cuticles when manicuring your nails. Use care when cutting your toenails .
  • Wash your hands with soap and warm water often, especially before you prepare food, after you use the bathroom, or after you touch soiled linens or clothes.
  • Protect your skin from scratches, sores, burns, and other irritations that might lead to an infection. Use electric razors to remove hair. and replace the razor head frequently.
  • Use insect repellents to prevent bug bites .

If you think have an infection, tell your doctor right away.

Stay alert for these warning signs of infection:

  • Fever over 100.4 degrees F
  • Sweats or chills
  • Skin rash
  • Pain, tenderness, redness, or swelling
  • A wound or cut that won’t heal
  • Red, warm, or draining sore
  • Sore throat. scratchy throat, or pain when swallowing
  • Sinus drainage, nasal congestion, headaches. or tenderness along upper cheekbones
  • Persistent dry or moist cough that lasts more than 2 days
  • White patches in your mouth or on your tongue
  • Nausea. vomiting. or diarrhea
  • Flu -like symptoms (chills, aches, headache. or fatigue ) or generally feeling “lousy”
  • Trouble peeing: pain or burning, constant urge, or needing to go often
  • Bloody, cloudy, or foul-smelling urine

Don’t wear tight clothing, shoes, or jewelry.

You should wear well-fitted bras. The straps shouldn’t be too tight, avoid underwires, and wear pads under the bra straps if necessary. Wear comfortable, closed-toe shoes and avoid tight hosiery. Wear watches or jewelry loosely, if at all, on the affected arm.

Don’t do any heavy lifting with the affected arm.

Avoid repetitive movements of the affected arm (such as scrubbing, pushing, or pulling). Don’t carry a purse or bag on the side where you had surgery.

Keep your skin clean.

Dry your skin thoroughly (including creases and between fingers and toes) and apply lotion.

Take precautions during visits to the doctor.

Ask to have your blood pressure checked on the unaffected arm. Get shots or blood drawn from that arm, if possible.

Tell your doctor about any symptoms.

Let her know if you have redness, swelling, a skin rash. or blistering on the side of your body where you had surgery, or if you have a temperature greater than 100.4 degrees F. These warning signs of infection could be an early sign of lymphedema and should be treated immediately.

What Can I Do if I Already Have Lymphedema?

Follow all of the recommendations for preventing lymphedema. That helps you lower the risk for more swelling.

It’s a good idea to follow these tips, too:

  • Avoid extreme temperature changes.
  • Do not use hot tubs, whirlpools, saunas, or steam baths.
  • Use warm, rather than hot, water when bathing or washing dishes.
  • Always wear sun protection (at least SPF 30) when going outdoors.
  • Talk to your doctor before traveling.
  • When traveling by air, ask your doctor if you should wear a compression sleeve on your affected arm or a stocking on your affected leg. For long flights, additional bandages may be needed.
  • When sitting or sleeping, elevate your affected arm or leg on pillows.
  • Don’t spend a lot of time lying on your affected side.

Your doctor may refer you to an occupational therapist (OT) who specializes in managing lymphedema. Your OT may have you do specific exercises, limit certain activities, and possibly recommend a compression sleeve or other devices.

See your doctor as recommended.

What’s the Outlook for Lymphedema?

With proper care and treatment, your affected limb can be restored to a normal size and shape. The condition can usually be controlled so that it doesn’t get worse.

But remember, it’s important to get your symptoms treated as soon as possible.
